Aquesta figura l&#8217;hem heretat de el <strong>dret rom\u00e0<\/strong> i s&#8217;assembla, per exemple, a les accions d&#8217;una societat an\u00f2nima o a les participacions de les societats limitades.<\/p>\n<p align=\"justify\">A continuaci\u00f3, t&#8217;expliquem en profunditat aquesta instituci\u00f3 de l&#8217;ordenament jur\u00eddic espanyol, nos especialment en les causes que motiven l&#8217;extinci\u00f3 de la copropietat de qualsevol b\u00e9.<\/p>\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_17 counter-hierarchy counter-numeric ez-toc-transparent\">\n<div class=\"ez-toc-title-container\">\n<p class=\"ez-toc-title\">Resumen del art&iacute;culo<\/p>\n<span class=\"ez-toc-title-toggle\"><a class=\"ez-toc-pull-right ez-toc-btn ez-toc-btn-xs ez-toc-btn-default ez-toc-toggle\" style=\"display: none;\"><i class=\"ez-toc-glyphicon ez-toc-icon-toggle\"><\/i><\/a><\/span><\/div>\n<nav><ul class=\"ez-toc-list ez-toc-list-level-1\"><li class=\"ez-toc-page-1 ez-toc-heading-level-2\"><a class=\"ez-toc-link ez-toc-heading-1\" href=\"https:\/\/garanley.com\/ca\/dret-civil\/copropietat-immobiliaria\/#copropietat-concepte-i-regulacio\" title=\"Copropietat: concepte i regulaci\u00f3\">Copropietat: concepte i regulaci\u00f3<\/a><ul class=\"ez-toc-list-level-3\"><li class=\"ez-toc-heading-level-3\"><a class=\"ez-toc-link ez-toc-heading-2\" href=\"https:\/\/garanley.com\/ca\/dret-civil\/copropietat-immobiliaria\/#extincio-de-la-copropietat\" title=\"Extinci\u00f3 de la copropietat\">Extinci\u00f3 de la copropietat<\/a><\/li><li class=\"ez-toc-page-1 ez-toc-heading-level-3\"><a class=\"ez-toc-link ez-toc-heading-3\" href=\"https:\/\/garanley.com\/ca\/dret-civil\/copropietat-immobiliaria\/#divisio-del-be-comu-a-catalunya\" title=\"Divisi\u00f3 del b\u00e9 com\u00fa a Catalunya\">Divisi\u00f3 del b\u00e9 com\u00fa a Catalunya<\/a><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n<h2 align=\"center\"><span class=\"ez-toc-section\" id=\"copropietat-concepte-i-regulacio\"><\/span>Copropietat: concepte i regulaci\u00f3<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p align=\"justify\">Pot ser que siguis, juntament amb els teus germans, titular de l&#8217;antic habitatge dels teus pares o que coneguis un cas semblant al teu entorn. Doncs b\u00e9, es tracta d&#8217;un dels exemples m\u00e9s usuals de <strong>copropietat.<\/strong> El condomini es caracteritza per les seg\u00fcents notes:<\/p>\n<ul>\n<li>\n<p align=\"justify\"><strong>Diverses persones titulars (f\u00edsiques o jur\u00eddiques) i sense l\u00edmit en el nombre.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Unitat del b\u00e9 objecte del\u00a0 dret. No es troba dividit en parts<\/strong>.<\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Cada copropietari posseeix una quota indivisa de l&#8217;objecte o dret, de la qual pot disposar lliurement.<\/strong><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\">Les copropietats sorgeixen per diferents situacions: adjudicacions d&#8217;un b\u00e9 a diversos hereus, adquisicions d&#8217;immobles en conjunt per parelles de fet, compres d&#8217;habitatges com a inversi\u00f3 etc.<\/p>\n<p align=\"justify\">Aquestes comunitats es regeixen, en primer terme, segons el<strong> pactat per les<\/strong> <strong>parts.<\/strong> En segon lloc s&#8217;han d&#8217;aplicar les <strong>normes espec\u00edfiques<\/strong> de cada cas i, si no hi ambdues, s&#8217;ha d&#8217;acudir al que estableix el <strong>Codi Civil.<\/strong><\/p>\n<p align=\"justify\">Per tant, la regulaci\u00f3 de la copropietat en el Codi Civil (CC) t\u00e9 car\u00e0cter dispositiu, ja que <strong>prevalen els acords o pactes signats per les parts<\/strong>, excepte quan es tracta de cl\u00e0usules relatives a el dret a exercir la divisi\u00f3 i la lliure disposici\u00f3 de cada part\u00edcip.<\/p>\n<p align=\"justify\">Tingues en compte aquests aspectes fonamentals de la regulaci\u00f3 del condomini en el C.C. espanyol:<\/p>\n<ul>\n<li>\n<p align=\"justify\"><strong>El concurs dels copropietaris \u00e9s proporcional a les seves respectives quotes.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Cadascun dels part\u00edcips pot servir-se de el b\u00e9 com\u00fa, sempre que no perjudiqui el dret de la resta i disposi de la mateixa conforme al seu dest\u00ed.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>\u00danicament el copropietari que renuncia a la seva part en el domini queda eximit de l&#8217;obligaci\u00f3 de contribuir a les despeses de conservaci\u00f3 de la cosa comuna.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Cap dels titulars pot, sense consentiment de la resta, alterar el b\u00e9, encara que de les modificacions es derivessin avantatges per a tothom.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>S\u00f3n v\u00e0lids els pactes per conservar la cosa indivisa per temps determinat, sempre que no excedeixi de deu anys. El termini es pot prorrogar per nova convenci\u00f3.<\/strong><\/p>\n<\/li>\n<\/ul>\n<h3 align=\"center\"><span class=\"ez-toc-section\" id=\"extincio-de-la-copropietat\"><\/span>Extinci\u00f3 de la copropietat<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<blockquote>\n<p align=\"justify\">L&#8217;article 400 del C.C. assenyala que &#8220;cap copropietari estar\u00e0 obligat a romandre en la comunitat. Cada un d&#8217;ells podr\u00e0 demanar en qualsevol temps que es divideixi la cosa comuna &#8220;. No obstant aix\u00f2, no es pot exigir aquesta operaci\u00f3 quan de la mateixa result\u00e9s la inutilitat de la cosa per a l&#8217;\u00fas a qu\u00e8 es destina.<\/p>\n<\/blockquote>\n<p align=\"justify\">L&#8217;actual crisi econ\u00f2mica i els problemes que, de vegades, es generen en el si de les comunitats estan provocant un <strong>augment en el nombre d&#8217;extincions<\/strong> <strong>de condominis<\/strong>. En molts casos, es recorre als acords entre part\u00edcips, perqu\u00e8 un d&#8217;ells es mantingui com a titular en exclusiva, compensant als restants. No obstant aix\u00f2, no sempre resulta pac\u00edfic el proc\u00e9s. De vegades, cal iniciar un <strong>procediment judicial de divisi\u00f3 de la cosa comuna<\/strong> o vendre a un tercer la corresponent participaci\u00f3.<\/p>\n<p align=\"justify\">Per\u00f2 la divisi\u00f3 de la cosa comuna no \u00e9s l&#8217;\u00fanica causa que extingeix la comunitat. Anota aquests altres motius que <strong>dissolen el condomini<\/strong>:<\/p>\n<ul>\n<li>\n<p align=\"justify\"><strong>P\u00e8rdua de el dret (usucapi\u00f3, per exemple).<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Desaparici\u00f3 de la cosa.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Acord per unanimitat de tots els cotitulars.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Venciment del termini.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Compliment de la condici\u00f3 resolut\u00f2ria acordada<\/strong><\/p>\n<\/li>\n<\/ul>\n<h3 align=\"center\"><span class=\"ez-toc-section\" id=\"divisio-del-be-comu-a-catalunya\"><\/span>Divisi\u00f3 del b\u00e9 com\u00fa a Catalunya<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p align=\"justify\">Si fas un cop d&#8217;ull a la<strong> Llei 5\/2006, de 10 de maig, de el Llibre Cinqu\u00e8 de el<\/strong> <strong>Codi Civil de Catalunya<\/strong>, relatiu als drets reals, podr\u00e0s llegir en el seu article 522-10 que &#8220;<em>qualsevol titular pot exigir, en qualsevol moment i<\/em> <em>sense expressar els seus motius, la divisi\u00f3 de l&#8217;objecte de la comunitat<\/em> &#8220;. No obstant aix\u00f2 i com passa en el dret com\u00fa, \u00e9s possible pactar la conservaci\u00f3 de la cosa per un temps determinat no superior a deu anys.<\/p>\n<p align=\"justify\">El procediment de divisi\u00f3 en la legislaci\u00f3 catalana \u00e9s el seg\u00fcent:<\/p>\n<ul>\n<li>\n<p align=\"justify\">A falta d&#8217;acord per a dividir la comunitat o per sotmetre a arbitratge, <strong>qualsevol dels copropietaris pot demanar que sigui l&#8217;autoritat judicial la que realitzi el proc\u00e9s de divisi\u00f3.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\">Quan la cosa sigui un b\u00e9 immoble susceptible de constituir-se en r\u00e8gim de<strong> propietat horitzontal (admet divisi\u00f3 material)<\/strong>, es pot optar per aquesta alternativa. Aix\u00ed, cada un dels comuners passa a convertir-se en propietari exclusiu d&#8217;un b\u00e9, de manera proporcional als drets que ostentava en la comunitat dissolta.<\/p>\n<\/li>\n<li>\n<p align=\"justify\">Una altra opci\u00f3 \u00e9s <strong>adjudicar a un o m\u00e9s part\u00edcips el dret d&#8217;usdefruit sobre la cosa i a la resta de comuners la nua propietat.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Els cotitulars que posseeixen a el menys les quatre cinquenes parts de les quotes poden exigir a la resta l&#8217;adjudicaci\u00f3 de la cosa, pagant-los el valor de les seves respectives aportacions.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><strong>Si l&#8217;objecte \u00e9s indivisible o desmereix notablement a l&#8217;escindir-se, l&#8217;adjudicaci\u00f3 es realitza al cotitular que tingui inter\u00e8s en el mateix. En cas d&#8217;existir m\u00e9s d&#8217;un, a qu\u00e8 tingui la participaci\u00f3 m\u00e9s gran.<\/strong><\/p>\n<\/li>\n<li>\n<p align=\"justify\">En els casos de<strong> separaci\u00f3, divorci o nul\u00b7litat matrimonial<\/strong>, les comunitats poden dividir considerant una sola divisi\u00f3 la totalitat o una part dels b\u00e9ns.<\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\">Com pots comprovar, s\u00f3n diverses les alternatives possibles a l&#8217;hora d&#8217;extingir un condomini.
