No cal que s&#8217;acumulin els salaris perqu\u00e8 puguis reclamar-los. En el moment en qu\u00e8 et s&#8217;hagin un import derivat de la relaci\u00f3 laboral passat el termini establert ja est\u00e0s en el teu dret de exigir-ho. A m\u00e9s, no cal que estiguis treballant a l&#8217;empresa per demanar que se&#8217;t pagui aquest salari endarrerit.<\/p>\n<p>\u00c9s important que s\u00e0pigues que un cop transcorregut l&#8217;any des del moment en qu\u00e8 et van haver de pagar i no ho van fer perds el teu dret a exigir la n\u00f2mina impagada. Per tant, \u00e9s millor no c\u00f3rrer riscos i posar de manifest que es protesta per l&#8217;impagament de salari.<\/p>\n<p>En el cas que l&#8217;empresari amb el qual mantens la relaci\u00f3 laboral es declari insolvent sempre hi ha el FOGASA, que es far\u00e0 c\u00e0rrec del deute. Perqu\u00e8 aix\u00f2 succeeixi cal haver demandat pr\u00e8viament.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"la-reclamacio-laboral\"><\/span>La reclamaci\u00f3 laboral<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Hi ha un pas previ a la demanda que has de portar a terme davant el <strong>Centre de Mediaci\u00f3, Arbitratge i Conciliaci\u00f3. El de Barcelona es troba al carrer Carrer Carrera n\u00famero 24.<\/strong><\/p>\n<p>Aquest pas \u00e9s la <strong>conciliaci\u00f3 laboral pr\u00e8via<\/strong> i b\u00e0sicament consisteix en que li demanes a l&#8217;empresa davant d&#8217;aquest organisme que et pagui els salaris pendents. Aquesta pot fer-ho, no fer-ho, pagar una part o no assistir a aquest acte. L&#8217;important d&#8217;aquest apartat \u00e9s que \u00e9s un requisit processal per poder interposar la demanda pr\u00f2piament dita.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"inici-del-proces\"><\/span>Inici del proc\u00e9s<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Si has passat el proc\u00e9s previ i l&#8217;empresa no t&#8217;ha pagat el que t&#8217;ha de llavors es presenta la demanda davant el jutjat social. Si les quantitats que et deu l&#8217;empresa s\u00f3n inferiors a 6.000 \u20ac est\u00e0 legalment establert que el treballador, o sigui tu, pugui fer \u00fas del <strong>proc\u00e9s monitori laboral<\/strong>, que consisteix en:<\/p>\n<p><strong>S&#8217;inicia amb un document<\/strong> que recull la identitat del treballador demandant i l&#8217;empresa demandada, la relaci\u00f3 laboral que els unia, el contracte, el salari estipulat i el justificant que hi va haver un intent previ de conciliaci\u00f3.<\/p>\n<p>Un cop presentat l&#8217;escrit corresponent, <strong>l&#8217;empresa t\u00e9 10 dies per pagar o per<\/strong> <strong>rebutjar la demanda<\/strong>. Si no contesta, es porta a terme de forma autom\u00e0tica l&#8217;execuci\u00f3 contra ella. Si paga la totalitat de l&#8217;salari endarrerit l&#8217;assumpte queda tancat. Si paga nom\u00e9s una part pots demanar l&#8217;execuci\u00f3 de la part restant i si s&#8217;oposa a el pagament total s&#8217;inicia la demanda pr\u00f2piament dita.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"la-demanda\"><\/span>La demanda<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>Si l&#8217;empresa no paga, finalment recorrerem a la demanda<\/strong>. En el moment previ a la seva interposici\u00f3 s&#8217;ha de rec\u00f3rrer tamb\u00e9 a una <strong>nova<\/strong> <strong>conciliaci\u00f3 davant el lletrat de l&#8217;administraci\u00f3 de just\u00edcia<\/strong>. Si aquesta conciliaci\u00f3 \u00e9s satisfact\u00f2ria el proc\u00e9s s&#8217;acaba i no es va a judici. Les empreses solen preferir aquest m\u00e8tode per la possibilitat de dur a terme el pagament de forma fraccionada abans d&#8217;anar a judici i pagar tota la quantitat deguda de cop sota la possibilitat d&#8217;execuci\u00f3.<\/p>\n<p>En cas contrari, els demandants i els seus<strong> advocats<\/strong> es preparen per al judici. \u00c9s important esmentar que l&#8217;empresa \u00e9s la que ha de demostrar que ha pagat els salaris reclamats en termini, \u00e9s a dir, que la c\u00e0rrega de la prova recau sobre la companyia.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"que-es-el-fons-de-garantia-salarial\"><\/span>Qu\u00e8 \u00e9s el Fons de Garantia Salarial?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>El <span style=\"color: #00ffff;\">Fons de Garantia Salarial (FOGASA)<\/span> \u00e9s un organisme p\u00fablic, aut\u00f2nom i d&#8217;\u00e0mbit nacional creat per garantir als treballadors el cobrament dels salaris i les indemnitzacions per acomiadament o finalitzaci\u00f3 de la relaci\u00f3 laboral, pendents de pagament per insolv\u00e8ncia de l&#8217;empresa.<\/p>\n<p>Beneficiari de tals fons pot ser qualsevol treballador que hagi tingut un contracte laboral amb l&#8217;empresa, amb exclusi\u00f3 dels socis de cooperatives i els treballadors de la llar.<\/p>\n<p>El Fons de Garantia Salarial es finan\u00e7a en gran part a trav\u00e9s de les aportacions de les empreses, p\u00fabliques i privades, que paguen per aix\u00f2 un percentatge sobre el salari de cada treballador contractat i que s&#8217;actualitza anualment.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"retribucions-i-indemnitzacions-garantides-pel-fogasa\"><\/span>Retribucions i indemnitzacions garantides pel FOGASA<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>El FOGASA garanteix el pagament de:<\/p>\n<ul>\n<li>Els salaris i les pagues extraordin\u00e0ries pendents de pagament a causa de la insolv\u00e8ncia o concurs de l&#8217;empresa. Hi ha un import m\u00e0xim que correspon al doble SMI, <span style=\"color: #00ffff;\">el salari m\u00ednim interprofessional.<\/span><\/li>\n<li>Les indemnitzacions pendents de pagar per l&#8217;empresa per conseq\u00fc\u00e8ncia d&#8217;un acomiadament improcedent, extinci\u00f3 d&#8217;el contracte per causa justa per part del treballador, extinci\u00f3 dels contractes temporals o de durada determinada, indemnitzacions per extinci\u00f3 col\u00b7lectives.<\/li>\n<\/ul>\n<p>El FOGASA no garanteix:<\/p>\n<ul>\n<li>Les indemnitzacions que s&#8217;han reconegut en un acte de conciliaci\u00f3<\/li>\n<li>Els plusos de transport, dietes, vestuari, etc.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"com-puc-tramitar-la-sollicitud-de-les-prestacions-a-fogasa\"><\/span>Com puc tramitar la sol\u00b7licitud de les prestacions a FOGASA?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>La sol\u00b7licitud es pot presentar en el per\u00edode m\u00e0xim d&#8217;un any a partir de la data de l&#8217;Acta de Conciliaci\u00f3, de la sent\u00e8ncia o de la resoluci\u00f3 per part de l&#8217;autoritat laboral, presentant un model oficial acompanyat de la documentaci\u00f3 complementar necess\u00e0ria i d&#8217;un document que comprovi la insolv\u00e8ncia de l&#8217;empresari.<\/p>\n<p>El procediment de tramitaci\u00f3 es pot iniciar d&#8217;ofici o a inst\u00e0ncia de l&#8217;interessat. En aquest cas la sol\u00b7licitud es presenta a la Unitat Administrativa de FOGASA de la prov\u00edncia on es troba el lloc de treball.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"quant-trigare-a-rebre-els-diners\"><\/span>Quant trigar\u00e9 a rebre els diners?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Un cop resolt l&#8217;expedient, la llei preveu un per\u00edode de 3 mesos per al cobrament de les prestacions pendents.<\/p>\n<p>No obstant aix\u00f2, en la realitat els terminis s\u00f3n m\u00e9s llargs i poden arribar a ser de m\u00e9s d&#8217;un any.<\/p>\n<p>\u00c9s molt important presentar la sol\u00b7licitud i la documentaci\u00f3 completa en els temps establerts, i per aix\u00f2 el <a href=\"http:\/\/garanley.com\/ca\/advocats-laboral\/\"><span style=\"color: #00ffff;\">suport d&#8217;un advocat laboralista<\/span> <\/a>et pot ajudar a tramitar el procediment de la manera m\u00e9s adequada.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Com advocats, en moltes ocasions ens hem topat amb un problema molt com\u00fa entre els treballadors com \u00e9s l&#8217;impagament dels salaris.
