Aquestes premisses es succeeixen en tres moments diferents: abans, durant i despr\u00e9s de la compravenda pr\u00f2piament dita.<\/strong><\/p>\n<hr \/>\n<p>Les operacions de<strong> compravenda d&#8217;habitatges i locals a Espanya<\/strong> comencen a recuperar-se despr\u00e9s de la crisi. Es tracta d&#8217;una quantitat que es confia en cust\u00f2dia a la immobili\u00e0ria, perqu\u00e8 reservi l&#8217;habitatge o local a l&#8217;interessat. Aquesta quantitat \u00e9s variable en funci\u00f3 de la valor de compravenda, tot i que oscil\u00b7la entre els 3.000 i els 12.000 euros. En el <strong>contracte de reserva<\/strong> s&#8217;han de reflectir les dades personals de les parts, documents acreditatius, preu de venda i la resta d&#8217;estipulacions acordades. T&#8217;aconsellem no pagar el dip\u00f2sit directament a venedor.<\/p>\n<p>D&#8217;altra banda, recorda que aquest ha de proporcionar-te una <strong>c\u00f2pia de l&#8217;escriptura notarial<\/strong>, per acreditar que realment \u00e9s el propietari de el pis o local. En aquest document hi figuren les dades relatives al Registre de la Propietat.<\/p>\n<p>Amb aquesta informaci\u00f3, proporcionada pel propietari, has de dirigir al Registre i<strong> sol\u00b7licitar una<\/strong> <strong>nota simple informativa de l&#8217;immoble en q\u00fcesti\u00f3<\/strong>. Amb la mateixa, podr\u00e0s constatar que la propietat est\u00e0 lliure d&#8217;embargaments, hipoteques, deutes, condicions resolut\u00f2ries o qualsevol tipus de c\u00e0rrega.<\/p>\n<p>\u00c9s freq\u00fcent que apareguin<strong> hipoteques<\/strong> a les notes simples. Si \u00e9s el cas, has de valorar, com a comprador, si t&#8217;interessa subrogarte o no. <strong>Qu\u00e8 implica l&#8217;acceptaci\u00f3 de la subrogaci\u00f3 ?<\/strong>. Si accedeixes, et converteixes en deutor \/ a, enfront de l&#8217;entitat financera, de la quantitat que resta per pagar. Una altra opci\u00f3 \u00e9s que contractis el teu propi pr\u00e9stec hipotecari.<\/p>\n<p>Una q\u00fcesti\u00f3 important \u00e9s la <strong>quota a pagar a la comunitat de propietaris<\/strong>, cas d&#8217;existir aquesta \u00faltima. \u00c9s aconsellable comprovar per endavant que els pagaments estan a el dia i, si escau, determinar els endarreriments pendents.<\/p>\n<p>Igualment, has de sol\u00b7licitar al venedor l&#8217;\u00faltim rebut de<strong> l&#8217;IBI<\/strong> (Impost de B\u00e9ns Immobles), per con\u00e8ixer l&#8217;estat de pagament d&#8217;aquest tribut.<\/p>\n<p>En les compravendes d&#8217;immobles \u00e9s com\u00fa que, abans de l&#8217;escriptura p\u00fablica, es signi un <strong>contracte privat<\/strong>, tamb\u00e9 anomenat <strong>precontracte<\/strong>, entre les dues parts. Recorda, per\u00f2, que <strong>no \u00e9s<\/strong> <strong>obligatori<\/strong>. Aix\u00f2 s\u00ed, tot i aquest \u00faltim detall, \u00e9s preceptiu executar tot el que s&#8217;ha pactat en el mateix. Un document d&#8217;aquestes caracter\u00edstiques no \u00e9s suficient per a la inscripci\u00f3 en el Registre de la Propietat. Per efectuar aquesta \u00faltima, \u00e9s imprescindible la corresponent escriptura p\u00fablica.<\/p>\n<p>En el contracte s&#8217;ha d&#8217;establir el preu de l&#8217;immoble, les<strong> arres<\/strong> o <strong>senyal<\/strong> i els terminis que es pactin.<\/p>\n<p>Pel que fa a la<strong> plusv\u00e0lua <\/strong>(Impost Municipal sobre l&#8217;Increment de Valor dels terrenys de naturalesa urbana), tingues present que, si no hi ha pacte en contra, va a c\u00e0rrec del venedor.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"escriptura-publica-de-compravenda\"><\/span>Escriptura p\u00fablica de compravenda<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Es tracta del document p\u00fablic atorgat davant notari, en el qual es reflecteix la compravenda realitzada. Ofereix interessants avantatges, que la diferencien d&#8217;un document privat: aporta <strong>fehaciencia i seguretat jur\u00eddica<\/strong>. Com hem assenyalat anteriorment, \u00e9s requisit imprescindible per a inscriure l&#8217;habitatge en el Registre de la Propietat i poder garantir aix\u00ed la pertinen\u00e7a davant de tercers.<\/p>\n<p>L&#8217;escriptura p\u00fablica exigeix la contractaci\u00f3 d&#8217;un notari, de manera que has de tenir ben presents les despeses a assumir en concepte <strong>d&#8217;honoraris<\/strong>, a part dels <strong>d&#8217;inscripci\u00f3.<\/strong><\/p>\n<p>La seguretat jur\u00eddica que aporta una escriptura p\u00fablica es manifesta en una s\u00e8rie de comprovacions realitzades pel notari:<\/p>\n<ul>\n<li><strong>Identitat, capacitat i legitimaci\u00f3 de comprador i venedor.<\/strong><\/li>\n<li><strong>Dades cadastrals<\/strong> (se sol\u00b7licita l&#8217;acreditaci\u00f3 de la refer\u00e8ncia cadastral de l&#8217;habitatge i certificat gr\u00e0fic-descriptiu que s&#8217;incorpora a l&#8217;escriptura).<\/li>\n<li><strong>Certificat d&#8217;efici\u00e8ncia energ\u00e8tica.<\/strong><\/li>\n<li><strong>C\u00e8dula d&#8217;habitabilitat<\/strong><\/li>\n<li><strong>Advertiments de vicis ocults i obligacions fiscals<\/strong>. Impost de Transmissions Patrimonials i Actes Jur\u00eddics Documentats, Plusv\u00e0lua Municipal etc.<\/li>\n<li><strong>Identificaci\u00f3 de titulars reals en cas de societats mercantils.<\/strong><\/li>\n<li><strong>Revisi\u00f3 i estudi del pagament.<\/strong><\/li>\n<li><strong>Verificaci\u00f3 del t\u00edtol de venedor.<\/strong><\/li>\n<li><strong>Constataci\u00f3 de l&#8217;estat arrendatici de l&#8217;habitatge.<\/strong><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"diligencies-posteriors-a-la-compra\"><\/span>Dilig\u00e8ncies posteriors a la compra<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Un cop adquirit l&#8217;immoble per escriptura p\u00fablica, has d&#8217;<strong>abonar els oportuns tributs (IVA o Impost sobre Transmissions Patrimonials i Actes Jur\u00eddics Documentats) i inscriure la compra al Registre de la Propietat.<\/strong><\/p>\n<p>Per pagar els impostos disposes, generalment, de 30 dies o un mes de la data de l&#8217;escriptura p\u00fablica.<\/p>\n<p>\u00c9s important tenir present que els tr\u00e0mits legals difereixen quan parlem <strong>d&#8217;immobles de nova<\/strong> <strong>construcci\u00f3, habitatges protegits<\/strong> etc. Per solucionar els dubtes que puguin sorgir en cada cas concret, \u00e9s aconsellable dirigir-se a un despatx d&#8217;advocats competent en aquesta mat\u00e8ria i plantejar-los totes les q\u00fcestions fosques, abans de prendre una decisi\u00f3.
