Equival a un o dos mesos de renda i \u00e9s preceptiva per a la validesa de la relaci\u00f3 jur\u00eddica.<\/strong><\/p>\n<hr \/>\n<p>La fian\u00e7a sempre ha estat un dels punts m\u00e9s conflictius entre llogaters i propietaris en els <span style=\"color: #00ffff;\">contractes d&#8217;arrendament d&#8217;habitatges<\/span>. Segurament tens alguna experi\u00e8ncia, bona o dolenta, al respecte. A continuaci\u00f3, anem a explicar-te detalladament aquesta figura, regulada en la Llei d&#8217;Arrendaments Urbans.<\/p>\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_17 counter-hierarchy counter-numeric ez-toc-transparent\">\n<div class=\"ez-toc-title-container\">\n<p class=\"ez-toc-title\">Resumen del art&iacute;culo<\/p>\n<span class=\"ez-toc-title-toggle\"><a class=\"ez-toc-pull-right ez-toc-btn ez-toc-btn-xs ez-toc-btn-default ez-toc-toggle\" style=\"display: none;\"><i class=\"ez-toc-glyphicon ez-toc-icon-toggle\"><\/i><\/a><\/span><\/div>\n<nav><ul class=\"ez-toc-list ez-toc-list-level-1\"><li class=\"ez-toc-page-1 ez-toc-heading-level-2\"><a class=\"ez-toc-link ez-toc-heading-1\" href=\"https:\/\/garanley.com\/ca\/dret-civil\/fianca-contractes-arrendament\/#que-es-i-per-a-que-serveix-la-fianca\" title=\"Qu\u00e8 \u00e9s i per a qu\u00e8 serveix la fian\u00e7a\">Qu\u00e8 \u00e9s i per a qu\u00e8 serveix la fian\u00e7a<\/a><ul class=\"ez-toc-list-level-3\"><li class=\"ez-toc-heading-level-3\"><a class=\"ez-toc-link ez-toc-heading-2\" href=\"https:\/\/garanley.com\/ca\/dret-civil\/fianca-contractes-arrendament\/#lactualitzacio-de-la-fianca\" title=\"L&#8217;actualitzaci\u00f3 de la fian\u00e7a\">L&#8217;actualitzaci\u00f3 de la fian\u00e7a<\/a><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n<h2><span class=\"ez-toc-section\" id=\"que-es-i-per-a-que-serveix-la-fianca\"><\/span>Qu\u00e8 \u00e9s i per a qu\u00e8 serveix la fian\u00e7a<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La fian\u00e7a \u00e9s una <strong>garantia a favor l&#8217;arrendador<\/strong>, per mitj\u00e0 de la qual, el llogater \/ arrendatari ha de dipositar certa quantitat en met\u00e0l\u00b7lic a l&#8217;hora de formalitzar el contracte d&#8217;arrendament. Has de saber que t\u00e9 car\u00e0cter obligatori, \u00e9s a dir, no \u00e9s possible formalitzar un lloguer sense prestar la fian\u00e7a, perqu\u00e8 en cas contrari la relaci\u00f3 jur\u00eddica no seria v\u00e0lida. Aix\u00ed queda establert en l&#8217;article 36 de la<span style=\"color: #00ffff;\"> Llei d&#8217;Arrendaments Urbans (LAU).<\/span><\/p>\n<p>Segons la legislaci\u00f3 espanyola, la fian\u00e7a ser\u00e0 equivalent a <strong>una mensualitat de la renda<\/strong> en cas d&#8217;arrendaments d&#8217;habitatges i de dos quan es tracti de lloguers per a usos diferents. A m\u00e9s, durant els tres primers anys de contracte no ser\u00e0 possible actualitzar aquesta garantia. No obstant aix\u00f2, en cada pr\u00f2rroga l&#8217;arrendador podr\u00e0 sol\u00b7licitar un increment de la mateixa i l&#8217;arrendatari una disminuci\u00f3, fins arribar a el valor d&#8217;una o dues mensualitats, segons correspongui.<\/p>\n<p>Com acabes de comprovar, la fian\u00e7a \u00e9s una garantia a favor l&#8217;arrendador. Es tracta d&#8217;una obligaci\u00f3 legal d&#8217;un o dos mesos, segons els casos. No obstant aix\u00f2 i al marge, arrendador i arrendatari poden subscriure un altre tipus de garanties que protegeixin el propietari. En concret i en el precepte 36.5 de la LAU s&#8217;estableix: <em>&#8220;Les parts podran pactar qualsevol tipus de garantia de compliment per l&#8217;arrendatari de les seves obligacions arrendat\u00edcies addicional a la fian\u00e7a en met\u00e0l\u00b7lic&#8221;<\/em>. Aquesta \u00faltima es denomina<strong> fian\u00e7a contractual.<\/strong><\/p>\n<p>Les dues garanties, la fian\u00e7a legal i la contractual, tenen com a finalitat essencial protegir l&#8217;arrendador, que podr\u00e0 <strong>rescabalar-se en cas d&#8217;incompliments d&#8217;obligacions per part de<\/strong> <strong>l&#8217;inquil\u00ed o arrendatari<\/strong> (impagaments o deterioraments en l&#8217;immoble responsabilitat d&#8217;aquest).<\/p>\n<p>Al concloure el contracte de lloguer, el propietari ha de<strong> tornar<\/strong> \u00edntegra la fian\u00e7a, si l&#8217;immoble es lliura en bones condicions. En cas contrari, el propietari podria quedar-se amb una part o la totalitat de la garantia, per emprendre les oportunes millores i reparacions.<\/p>\n<p>En aquest punt, \u00e9s interessant que coneguis alguns <strong>drets i obligacions<\/strong> de les parts en el contracte d&#8217;arrendament. Segons estableix la llei, l&#8217;arrendador ha de realitzar les reparacions necess\u00e0ries per conservar l&#8217;habitatge en condicions d&#8217;habitabilitat \u00f2ptimes, excepte si els deterioraments s\u00f3n imputables a l&#8217;inquil\u00ed (articles 1.563 i 1.564 de el Codi Civil). Si l&#8217;obra dur\u00e9s m\u00e9s de vint dies, la renda s&#8217;ha de reduir proporcionalment. L&#8217;arrendatari ha de posar en coneixement de l&#8217;propietari, en el termini m\u00e9s breu possible, la necessitat d&#8217;implementar les oportunes reparacions. Les petites millores que exigeix el desgast per l&#8217;\u00fas diari s\u00f3n a c\u00e0rrec de l&#8217;inquil\u00ed. D&#8217;altra banda i en cas de venda de l&#8217;immoble llogat, l&#8217;arrendatari posseeix un dret d&#8217;adquisici\u00f3 preferent sobre la mateixa.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"lactualitzacio-de-la-fianca\"><\/span><strong>L&#8217;actualitzaci\u00f3 de la fian\u00e7a<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>La <span style=\"color: #00ffff;\"><strong>Llei 4\/2013, de 4 de juny, de Mesures de Flexibilitzaci\u00f3 i Foment de l&#8217;Mercat del Lloguer d&#8217;Habitatges<\/strong><\/span><strong>,<\/strong> va introduir novetats en el r\u00e8gim de les fiances. Per tal motiu i a l&#8217;hora d&#8217;analitzar l&#8217;actualitzaci\u00f3 de la garantia, has de tenir molt en compte la data en qu\u00e8 es va signar el contracte d&#8217;arrendament.<\/p>\n<p>Aix\u00ed, si el contracte es va signar abans de el <strong>6 de juny de 2013,<\/strong> l&#8217;import de la fian\u00e7a no pot alterar-se durant els cinc primers anys de la relaci\u00f3 jur\u00eddica. Per contra, si es va subscriure despr\u00e9s d&#8217;aquesta data, el per\u00edode de temps en el qual no \u00e9s possible modificar-la es redueix a tres.<\/p>\n<p><strong>Cust\u00f2dia i devoluci\u00f3<\/strong><\/p>\n<p>Com hem indicat anteriorment, la fian\u00e7a es retorna a la finalitzaci\u00f3 del contracte de lloguer. El precepte 36.4 de la LAU estableix, a m\u00e9s, que &#8220;<em>el saldo de la fian\u00e7a en met\u00e0l\u00b7lic que hagi de ser restitu\u00eft a l&#8217;arrendatari a la fi de l&#8217;arrendament produeix l&#8217;inter\u00e8s legal, transcorregut un mes des del lliurament de les claus per aquest sense que es s&#8217;hagi fet efectiva la restituci\u00f3<\/em> &#8220;.<\/p>\n<p>Per\u00f2 cal fer esment a la<strong> Disposici\u00f3 transit\u00f2ria tercera de la LAU.<\/strong> Aquesta obre la possibilitat a les comunitats aut\u00f2nomes d&#8217;establir l&#8217;obligaci\u00f3 als arrendadors perqu\u00e8 dipositin l&#8217;import de la garantia en un ens p\u00fablic de l&#8217;administraci\u00f3 auton\u00f2mica, fins al moment de extingir-se el contracte.<\/p>\n<p>A l&#8217;empara d&#8217;aquesta disposici\u00f3, la majoria de comunitats aut\u00f2nomes ja han legislat sobre aquest dep\u00f3sit de la fian\u00e7a.<\/p>\n<p>A <strong>Catalunya<\/strong>, la mat\u00e8ria queda regulada a la <strong>Llei 13\/1996, de 29 de juliol.<\/strong> Aquesta norma es va modificar, en part, per l&#8217;article 42 de la Llei 26\/2009, de 23 de desembre. La legislaci\u00f3 catalana obliga a l&#8217;arrendador a registrar i inscriure l&#8217;arrendament a l&#8217;<strong>Institut Catal\u00e0 de l&#8217;S\u00f2l<\/strong> (<strong>INCASOL).<\/strong> Per descomptat, tamb\u00e9 s&#8217;ha de dipositar la fian\u00e7a en la dita organisme. Si es tracta d&#8217;un arrendament de temporada, nom\u00e9s ser\u00e0 necessari el dip\u00f2sit de la part proporcional a la durada del contracte i no de la mensualitat completa. El propietari t\u00e9 un termini de dos mesos per efectuar la inscripci\u00f3, a comptar de la data de la signatura del contracte.<\/p>\n<p>Segons assenyala la norma catalana, l&#8217;arrendador ha de lliurar a l&#8217;arrendatari una c\u00f2pia de l&#8217;ingr\u00e9s de la garantia en l&#8217;INCASOL. En cas de faltes greus per part del propietari, les <strong>sancions econ\u00f2miques<\/strong> oscil\u00b7len entre el 35 i el 75 per cent de la quantia de la fian\u00e7a. Per la seva banda, les infraccions lleus (dip\u00f2sit tard\u00e0 de la garantia) es castiguen amb multes que no poden superar el 35 per cent de la valor d&#8217;aquella.<\/p>\n<p>En resum, la fian\u00e7a \u00e9s una garantia que s&#8217;estableix a favor de l&#8217;arrendador i que obliga legalment a l&#8217;inquil\u00ed a dipositar certa quantitat en met\u00e0l\u00b7lic a l&#8217;hora de formalitzar el contracte d&#8217;arrendament. Es tracta d&#8217;una font inesgotable de conflictes entre propietaris i llogaters.
