La <strong>usucapi\u00f3<\/strong>, tamb\u00e9 anomenada <strong>prescripci\u00f3 adquisitiva,<\/strong> \u00e9s una instituci\u00f3 jur\u00eddica d&#8217;origen rom\u00e0, que permet ser propietari d&#8217;un determinat dret real, si s&#8217;ha posse\u00eft durant un per\u00edode de temps establert legalment.<\/p>\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_17 counter-hierarchy counter-numeric ez-toc-transparent\">\n<div class=\"ez-toc-title-container\">\n<p class=\"ez-toc-title\">Resumen del art&iacute;culo<\/p>\n<span class=\"ez-toc-title-toggle\"><a class=\"ez-toc-pull-right ez-toc-btn ez-toc-btn-xs ez-toc-btn-default ez-toc-toggle\" style=\"display: none;\"><i class=\"ez-toc-glyphicon ez-toc-icon-toggle\"><\/i><\/a><\/span><\/div>\n<nav><ul class=\"ez-toc-list ez-toc-list-level-1\"><li class=\"ez-toc-page-1 ez-toc-heading-level-2\"><a class=\"ez-toc-link ez-toc-heading-1\" href=\"https:\/\/garanley.com\/ca\/dret-civil\/adquisicio-propietat-us-continuat-usucapio\/#la-usucapio-del-dret-roma\" title=\"La usucapio del dret rom\u00e0\">La usucapio del dret rom\u00e0<\/a><ul class=\"ez-toc-list-level-3\"><li class=\"ez-toc-heading-level-3\"><a class=\"ez-toc-link ez-toc-heading-2\" href=\"https:\/\/garanley.com\/ca\/dret-civil\/adquisicio-propietat-us-continuat-usucapio\/#regulacio-actual\" title=\"Regulaci\u00f3 actual\">Regulaci\u00f3 actual<\/a><\/li><li class=\"ez-toc-page-1 ez-toc-heading-level-3\"><a class=\"ez-toc-link ez-toc-heading-3\" href=\"https:\/\/garanley.com\/ca\/dret-civil\/adquisicio-propietat-us-continuat-usucapio\/#el-tribunal-suprem-i-la-usucapio-contra-tabulas\" title=\"El Tribunal Suprem i la usucapi\u00f3 &#8220;contra tabulas&#8221;\">El Tribunal Suprem i la usucapi\u00f3 &#8220;contra tabulas&#8221;<\/a><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n<h2><span class=\"ez-toc-section\" id=\"la-usucapio-del-dret-roma\"><\/span>La usucapio del dret rom\u00e0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&#8217;origen de la usucapi\u00f3 el trobem en el<strong> dret rom\u00e0.<\/strong> Etimol\u00f2gicament, la <em>usucapio<\/em> prov\u00e9 dels termes llatins <strong>usu capere<\/strong> (agafar per l&#8217;\u00fas). L&#8217;ordenament d&#8217;aquella \u00e8poca configurava aquesta instituci\u00f3 com una manera alternativa d&#8217;adquisici\u00f3 de la propietat. S&#8217;entenia que l&#8217;\u00fas continuat atorgava una<em> auctoritas<\/em> sobre la cosa en q\u00fcesti\u00f3.<\/p>\n<p>No obstant aix\u00f2, la<em> usucapio<\/em> romana exigia importants i destacats requisits. En primer lloc, no es podia usucapir per qualsevol motiu, nom\u00e9s per un de social i <strong>civilment justificat<\/strong>. En segon terme, era imprescindible l&#8217;exist\u00e8ncia de <strong>bona fe.<\/strong> Aquesta figura jur\u00eddica no suposava una despulla a l&#8217;anterior titular de la propietat, ja que aquest no s&#8217;oposava a la situaci\u00f3 de fet.<\/p>\n<p>La instituci\u00f3 jur\u00eddica de la <em>usucapio<\/em> va ser revolucion\u00e0ria en el m\u00f3n rom\u00e0, ja que va ajudar a aclarir molts casos i a resoldre litigis sobre propietat que s&#8217;eternitzaven en el temps. La instituci\u00f3 no s&#8217;aplicava sobre totes les coses, nom\u00e9s podia desplegar-se sobre les res habilis (coses id\u00f2nies o usucapibles).<\/p>\n<p>Altres requisits de la<em> usucapio<\/em> romana eren la<strong> Iusta causa i la bona fides<\/strong>, tal com d\u00e8iem anteriorment. La primera estava relacionada amb l&#8217;exist\u00e8ncia d&#8217;una relaci\u00f3 negocial entre usucapient i titular anterior. Per la seva banda, la<em> bona fides<\/em> es basava en la convicci\u00f3 per l&#8217;adquirent, en el moment d&#8217;entrar en possessi\u00f3 de la cosa, de no danyar drets d&#8217;altres persones.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"regulacio-actual\"><\/span><strong>Regulaci\u00f3 actual<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>El terme<em> &#8220;usucapi\u00f3&#8221;<\/em> no apareix en l&#8217;articulat de el <strong>Codi Civil<\/strong>. No obstant aix\u00f2, el precepte <strong>1930<\/strong> estableix: &#8220;<em>Per la prescripci\u00f3 s&#8217;adquireixen, de la manera i amb les condicions determinades en la llei, el domini i altres drets reals. Tamb\u00e9 s&#8217;extingeixen de la pr\u00f2pia manera per la prescripci\u00f3 dels drets i les accions, de qualsevol classe que siguin &#8220;.<\/em><\/p>\n<p>La usucapi\u00f3 o <strong>prescripci\u00f3 adquisitiva<\/strong> implica l&#8217;adquisici\u00f3 autom\u00e0tica de la cosa, sense necessitat d&#8217;una declaraci\u00f3 judicial del dret. El posse\u00efdor es converteix en propietari, despr\u00e9s de consumar-se el termini establert legalment. Per contra, si es promogu\u00e9s judici sobre la propietat, la usucapi\u00f3 s\u00ed hauria de ser provada.<\/p>\n<p>Tingues en compte tamb\u00e9 que la usucapi\u00f3 posseeix car\u00e0cter<strong> retroactiu<\/strong>. Aix\u00f2 vol dir que, un cop consumit el termini, s&#8217;ent\u00e9n que l&#8217;adquisici\u00f3 de el dret es va produir a l&#8217;inici d&#8217;aquella.<\/p>\n<p>S\u00f3n susceptibles de usucapi\u00f3 totes les coses que es trobin <strong>dins el comer\u00e7 dels homes<\/strong>. D&#8217;altra banda, la prescripci\u00f3 adquisitiva exigeix una s\u00e8rie de requisits en la possessi\u00f3. En conseq\u00fc\u00e8ncia i perqu\u00e8 el posse\u00efdor es converteixi en propietari, s&#8217;han de donar algunes circumst\u00e0ncies especials, que analitzem a continuaci\u00f3:<\/p>\n<ul>\n<li><strong>En concepte de propietari.<\/strong><\/li>\n<\/ul>\n<p>Significa que el posse\u00efdor ha de tenir la disposici\u00f3 de fet l&#8217;immoble o cosa i exercir-la com si fos l&#8217;amo.<\/p>\n<ul>\n<li><strong>P\u00fablica i pac\u00edfica.<\/strong><\/li>\n<\/ul>\n<p>La possessi\u00f3 s&#8217;ha d&#8217;exercir de manera que pugui ser coneguda, \u00e9s a dir, sense clandestinitat. Tampoc pot existir viol\u00e8ncia.<\/p>\n<ul>\n<li><strong>Continuada.<\/strong><\/li>\n<\/ul>\n<p>La possessi\u00f3 ha de ser continuada, \u00e9s a dir, no haver patit interrupcions.<\/p>\n<p>La usucapi\u00f3 pot ser <strong>ordin\u00e0ria<\/strong> o<strong> extraordin\u00e0ria<\/strong>. A la primera s&#8217;exigeix <strong>bona fe<\/strong> i <strong>just t\u00edtol.<\/strong> El termini que s&#8217;estableix \u00e9s de 10 anys per a b\u00e9ns immobles i de 20 si el propietari resideix a l&#8217;estranger. Per la seva banda, l&#8217;extraordin\u00e0ria no exigeix cap de les dues premisses abans ressenyades i el termini que es requereix \u00e9s de 30 anys per a b\u00e9ns immobles i de 6 per a b\u00e9ns mobles.<\/p>\n<p>Perqu\u00e8 pugui existir usucapi\u00f3 cal que no es doni una acci\u00f3 en contra de la possessi\u00f3 per part de la titular del dret.<\/p>\n<p>La usucapi\u00f3 es justifica en base a dues<strong> teories<\/strong> diferents:<\/p>\n<ul>\n<li><strong>Objectiva.<\/strong><\/li>\n<\/ul>\n<p>El fonament de la figura es troba en la seguretat que aporta a les relacions jur\u00eddiques, al consolidar les titularitats aparents.<\/p>\n<ul>\n<li><strong>Subjectiva.<\/strong><\/li>\n<\/ul>\n<p>Justifica l&#8217;exist\u00e8ncia de la usucapi\u00f3 a partir de l&#8217;aband\u00f3 o la ren\u00fancia a el dret real, per part de la titular de la mateixa. Quan aquest aconsegueix demostrar la inexist\u00e8ncia de la voluntat de ren\u00fancia, la usucapi\u00f3 perd la seva ra\u00f3 de ser.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"el-tribunal-suprem-i-la-usucapio-contra-tabulas\"><\/span><strong>El Tribunal Suprem i la usucapi\u00f3 &#8220;contra tabulas&#8221;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Recentment, el Tribunal Suprem ha fixat la doctrina a aplicar en relaci\u00f3 amb la usucapi\u00f3 &#8220;contra tabulas&#8221;. Segurament estiguis preguntant qu\u00e8 significa aquest concepte. Doncs b\u00e9, el mateix fa refer\u00e8ncia a <strong>l&#8217;adquisici\u00f3 de la propietat per al seu \u00fas continuat durant un temps concret i en contra del que recull el Registre de la Propietat.<\/strong><\/p>\n<p>El Tribunal ha sentenciat que ha de regir el que disposa l&#8217;article 36 de la Llei Hipotec\u00e0ria, davant el que recull l&#8217;1.949 de el Codi Civil. La ra\u00f3 \u00e9s que aquest \u00faltim ha de considerar derogat.<\/p>\n<p>La Llei Hipotec\u00e0ria acull dues situacions diferents i una regulaci\u00f3 diferent de l&#8217;anterior, en relaci\u00f3 amb la <strong>prescripci\u00f3 adquisitiva davant el tercer original.<\/strong> La usucapi\u00f3 &#8220;contra tabulas&#8221; planteja la q\u00fcesti\u00f3 de si pot ser usucapit per la possessi\u00f3 un dret inscrit en el Registre de la Propietat a nom d&#8217;una altra persona. Aquesta idea es contraposa amb la de <strong>usucapi\u00f3<\/strong> <strong>&#8220;secundum tabulas<\/strong>&#8220;, segons la qual, el titular d&#8217;el dret inscrit es beneficia de la presumpci\u00f3 de possessi\u00f3 amb just t\u00edtol, p\u00fablica, pac\u00edfica, ininterrompuda i de bona fe, durant el temps de vig\u00e8ncia de l&#8217;assentament i dels antecessors dels que porti causa.<\/p>\n<p>El tema de la usucapi\u00f3 i, en general, els litigis sobre propietats s\u00f3n q\u00fcestions complexes, que requereixen d&#8217;detallats an\u00e0lisi per part de professionals del dret.
