Cada vegada m\u00e9s resolucions judicials consideren aquests casos com accidents de treball, tot i que fins fa poc temps s&#8217;exclo\u00efen de el quadre general de malalties professionals<\/strong><\/p>\n<p align=\"justify\">En el m\u00f3n en qu\u00e8 vivim, cada vegada s\u00f3n m\u00e9s usuals els casos <strong>d&#8217;estr\u00e8s laboral<\/strong>. Probablement coneguis m\u00e9s d&#8217;una hist\u00f2ria d&#8217;aquest tipus entre els teus familiars o amics. Es tracta d&#8217;un estat de tensi\u00f3 personal propi de les societats avan\u00e7ades, on la pressi\u00f3 en l&#8217;\u00e0mbit de treball pot arribar a produir <strong>saturaci\u00f3 f\u00edsica i mental<\/strong> en els empleats. Les seves conseq\u00fc\u00e8ncies afecten la salut i a l&#8217;entorn dels treballadors que ho pateixen.<\/p>\n<p align=\"justify\">Aquesta afecci\u00f3 apareix quan les <strong>exig\u00e8ncies laborals superen la capacitat per fer-les front o<\/strong> <strong>controlar-les<\/strong> per part de la persona. Pot manifestar-se de manera lleu (irritabilitat, esgotament &#8230;) o greu (infart, ictus &#8230;).<\/p>\n<p align=\"justify\">L&#8217;estr\u00e8s en el treball s&#8217;associa amb un descens en la productivitat de l&#8217;empleat afectat i amb un dany seri\u00f3s en la seva qualitat de vida. En molts casos, desemboca en baixa o <strong>accident<\/strong> <strong>laboral.<\/strong><\/p>\n<h3 align=\"center\">Jurisprud\u00e8ncia relacionada amb l&#8217;estr\u00e8s com a accident laboral<\/h3>\n<p align=\"justify\">Durant molt de temps, <strong>l&#8217;estr\u00e8s no ha estat incl\u00f2s en el quadre de malalties professionals,<\/strong> encara que poc a poc es va reconeixent com a accident laboral.<\/p>\n<p align=\"justify\">Una de les \u00faltimes sent\u00e8ncies en les que l&#8217;estr\u00e8s s&#8217;ha reconegut com a accident laboral ha estat la del <strong>Jutjat del Social n\u00ba 3 de Bilbao.<\/strong> En la mateixa, s&#8217;estipula com a accident de treball l&#8217;estr\u00e8s posttraum\u00e0tic que va patir una treballadora de banca, v\u00edctima d&#8217;un atracament el 19 de juliol de 2001. El fet va oc\u00f3rrer a Durango (Biscaia) i, en el desenvolupament de la mateixa, <strong>la treballadora va ser amena\u00e7ada amb una arma de foc<\/strong>. El Servei Basc de Salut va determinar que la vida de la v\u00edctima est\u00e0 condicionada per la por a patir una altra agressi\u00f3 similar. La resoluci\u00f3 va concloure que l&#8217;entitat financera va haver de modificar i adequar correctament les condicions laborals de la dona. A l&#8217;no realitzar-ho, la salut d&#8217;aquesta va empitjorar.<\/p>\n<p align=\"justify\">El 1999, el <strong>Tribunal Superior de Just\u00edcia del Pa\u00eds Basc<\/strong> va dictar una sent\u00e8ncia, en la qual es va recon\u00e8ixer l&#8217;estr\u00e8s laboral d&#8217;un empleat de taller com a accident de treball. Les conclusions d&#8217;aquesta resoluci\u00f3 judicial s\u00f3n extrapolables a altres professions.<\/p>\n<p align=\"justify\">El 1998, el <strong>Tribunal Superior de Just\u00edcia de Castella i Lle\u00f3<\/strong> va considerar un intent de su\u00efcidi com accident de treball. Es va estimar que l&#8217;estr\u00e8s laboral va emp\u00e8nyer a l&#8217;empleat a su\u00efcidar-se. L&#8217;home comptava amb 18 anys d&#8217;experi\u00e8ncia en l&#8217;empresa i <strong>va ingerir una ampolla<\/strong> <strong>d&#8217;ars\u00e8nic<\/strong>, que finalment no li va causar la mort, perqu\u00e8 <strong>se sentia responsable de la greu situaci\u00f3 econ\u00f2mica per la qual travessava la companyia.<\/strong><\/p>\n<p align=\"justify\">D&#8217;altra banda, la <strong>Sala Primera del Tribunal Suprem<\/strong> ha concl\u00f2s que un infart, sofert com a conseq\u00fc\u00e8ncia d&#8217;un fort estr\u00e8s laboral, tamb\u00e9 s&#8217;ha de considerar accident de treball. En la resoluci\u00f3 que avala aquesta conclusi\u00f3 va quedar demostrada la <strong>relaci\u00f3 de causalitat entre la cardiopatia i l&#8217;esgotament f\u00edsic i intel\u00b7lectual generat al afectat.<\/strong><\/p>\n<p align=\"justify\"><strong>El Jutjat del Social n\u00ba 11 de Sevilla<\/strong> va precedent el 2012, a l&#8217;considerar com a accident laboral un vessament cerebral sofert per un treballador a causa de l&#8217;estr\u00e8s acumulat, tot i que la v\u00edctima es trobava<strong> fora de l&#8217;horari de treball (cap de setmana).\u00a0<\/strong><\/p>\n<p align=\"justify\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 Avaluaci\u00f3<\/p>\n<p align=\"justify\">Per determinar si pateixes o no un estr\u00e8s laboral, un perit psic\u00f2leg realitzar\u00e0 un estudi per endevinar els possibles motius del teu estat. Es tracta d&#8217;evitar les simulacions i l&#8217;exageraci\u00f3 de s\u00edmptomes. Un cop conegudes les causes de l&#8217;estr\u00e8s, caldr\u00e0 examinar si les mateixes s&#8217;inclouen dins dels <strong>estressors objectius o subjectius<\/strong>. Els primers poden percebre per subjectes externs a l&#8217;organitzaci\u00f3 i juguen un paper rellevant en l&#8217;evoluci\u00f3 de l&#8217;estr\u00e8s en la persona. Per la seva banda, els subjectius es refereixen a la valoraci\u00f3 interna que cada individu realitza al voltant dels estressors objectius, tenint en compte els recursos de qu\u00e8 disposa per combatre&#8217;ls.<\/p>\n<p align=\"justify\">Perqu\u00e8 <strong>l&#8217;estr\u00e8s<\/strong> sigui qualificat com a <strong>accident de treball<\/strong> ha d&#8217;estar generat <strong>per un o diversos<\/strong> <strong>estressors objectius.<\/strong> Aquests s&#8217;han de configurar com a necessaris i suficients per originar el corresponent quadre d&#8217;estr\u00e8s laboral.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L&#8217;estr\u00e8s laboral \u00e9s un mal que s&#8217;incrementa amb for\u00e7a en la societat dels nostres dies.
