Per\u00f2 hi ha una soluci\u00f3 en cas que aix\u00f2 passi: el <strong>desnonament per impagament de lloguer<\/strong>. Es tracta del procediment judicial mitjan\u00e7ant el qual l&#8217;arrendador pot recuperar l&#8217;immoble que ha posat en lloguer.<\/p>\n<p>El propietari pot demanar a l&#8217;inquil\u00ed quan aquest s&#8217;apodera de l&#8217;immoble sense pagar la renda corresponent. Tamb\u00e9 quan deixa de pagar les despeses associades al lloguer, com els serveis, o incompleix amb els termes del contracte.<\/p>\n<p>Cap propietari vol passar per aquest tipus de procediment perqu\u00e8 resulta inc\u00f2mode i pot portar temps. De vegades, quan hi ha casos d&#8217;impagament, es tracta d&#8217;arribar a un acord amb el llogater. \u00c9s possible que el retard es degui a algun problema temporal i que esperen resoldre per complir amb el seu comprom\u00eds.<\/p>\n<p>Per a aquests casos es pot afegir una cl\u00e0usula al contracte, atorgar m\u00e9s temps per realitzar el pagament o fer un descompte. Hi ha propietaris que fins i tot perdonen el pagament d&#8217;alguna mensualitat per consideraci\u00f3 a l&#8217;inquil\u00ed. Aquestes mesures s\u00f3n comuns quan han mantingut una bona relaci\u00f3 i comunicaci\u00f3 entre les parts.<\/p>\n<p>No sempre \u00e9s aix\u00ed. O, fins i tot, poden arribar a un acord d&#8217;aquest tipus i el llogater torna a fallar. Llavors \u00e9s quan el propietari decideix prendre accions.<\/p>\n<p>Si est\u00e0 clar que l&#8217;inquil\u00ed mor\u00f3s no t\u00e9 intencions de pagar llavors s&#8217;envia un burofax. En aquest s&#8217;ha d&#8217;especificar el termini que t\u00e9 l&#8217;arrendador per pagar el deute pendent. Si tot i aix\u00ed no es compleix, llavors pot acudir a un<a href=\"http:\/\/garanley.com\/ca\/advocats-civilistes\/\"> <span style=\"color: #33cccc;\">advocat especialista en dret civil.<\/span><\/a><\/p>\n<p>Mitjan\u00e7ant el <strong>desnonament expr\u00e9s<\/strong> dels advocats busquen que l&#8217;ordre de desnonament es concreti en el menor temps possible. D&#8217;aquesta manera, el llogater ha d&#8217;abandonar l&#8217;immoble immediatament, sense temps d&#8217;iniciar accions legals.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"quins-son-els-tipus-de-desnonament-que-hi-ha\"><\/span>Quins s\u00f3n els tipus de desnonament que hi ha?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&#8217;increment de nombre de llogaters que s&#8217;apropien d&#8217;un immoble sense complir el contracte \u00e9s una realitat a Espanya. Davant d&#8217;aix\u00f2, s&#8217;ha procurat tenir normes m\u00e9s contundents que permetin que l&#8217;arrendador recuperi el gaudi de la propietat.<br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-2481\" src=\"http:\/\/garanley.com\/wp-content\/uploads\/Inquilino-moroso.jpg\" alt=\"Inquilino moroso\" width=\"300\" height=\"336\" \/><\/p>\n<p>Cal destacar que l&#8217;arrendatari t\u00e9 dret a la defensa i a oposar-se a la mesura. Per a aix\u00f2 ha de demostrar que no ha de les rendes ni ha incomplert amb el contracte.<\/p>\n<p>Abans de parlar sobre el judici de desnonament express coneguem quins s\u00f3n els tipus de desnonament.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"desnonament-per-comodat\"><\/span>Desnonament per comodat<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>El<strong> desnonament d&#8217;immobles per comodat<\/strong> passa quan l&#8217;inquil\u00ed incompleix els pagaments o decideix romandre en l&#8217;habitatge m\u00e9s temps de l&#8217;acordat. En aquest cas hi ha un contracte en el qual s&#8217;estableix tant el temps de durada com la suma a pagar.<\/p>\n<p>Trobar una soluci\u00f3 r\u00e0pida a aquests casos \u00e9s m\u00e9s senzill per l&#8217;exist\u00e8ncia de l&#8217;acord. El que fa m\u00e9s viable comprovar la falta en qu\u00e8 incorre l&#8217;arrendatari.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"desnonament-per-precari\"><\/span>Desnonament per precari<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Al contrari que el cas anterior, aquesta vegada no hi ha un contracte pel mig que estipuli ni pagament ni temps de perman\u00e8ncia. Pot ser que passi un acord verbal, per\u00f2 aquest no suposa un contracte com a tal.<\/p>\n<p>Passa, per exemple, en aquells casos en qu\u00e8 es deixa a un familiar a la cura d&#8217;un immoble. Quan ha estat ocupat sense consentiment previ o quan algun cohereu hagi fet \u00fas exclusiu del mateix.<\/p>\n<p>A part d&#8217;aquestes tamb\u00e9 hi ha altres circumst\u00e0ncies en qu\u00e8 es pot rec\u00f3rrer a un judici de desnonament per precari. El fet \u00e9s que en el moment en qu\u00e8 el propietari desitja gaudir de l&#8217;immoble no s&#8217;aconsegueix un acord de desallotjament. Llavors es recorre a la via judicial.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"en-quins-altres-casos-es-pot-sollicitar-a-ldesnonament\"><\/span>En quins altres casos es pot sol\u00b7licitar a l&#8217;desnonament?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Fins ara els casos que hem descrit tenen a veure amb l&#8217;incompliment de la renda o l&#8217;<strong>apropiaci\u00f3 de l&#8217;habitatge de lloguer.<\/strong> Per\u00f2, en la Llei d&#8217;Arrendaments Urbans tamb\u00e9 s&#8217;estableixen altres casos que poden acabar en l&#8217;expulsi\u00f3 de l&#8217;inquil\u00ed.<\/p>\n<p>Aqu\u00ed s&#8217;inclouen situacions com que l&#8217;inquil\u00ed subarrende l&#8217;habitatge sense el consentiment del propietari. Tamb\u00e9 quan l&#8217;amo demostra que s&#8217;estan realitzant activitats il\u00b7l\u00edcites o perilloses en l&#8217;habitatge o local comercial. Si el llogater comen\u00e7a una obra sense autoritzaci\u00f3 o provoca algun tipus de dany intencionat a l&#8217;estructura.<\/p>\n<p>Per resoldre circumst\u00e0ncies com les anteriors s&#8217;ha de fer mitjan\u00e7ant un judici ordinari.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"quant-de-temps-porta-desallotjar-un-inquili-moros\"><\/span>Quant de temps porta desallotjar un inquil\u00ed mor\u00f3s?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>El desallotjament d&#8217;un inquil\u00ed mor\u00f3s d&#8217;una propietat llogada pot portar fins a m\u00e9s d&#8217;un any. Dep\u00e8n de diversos factors el temps total que es prengui. Entre els quals podem esmentar el lloc on est\u00e0 l&#8217;immoble i quant tarda el propietari en demanar des que l&#8217;arrendatari deixa de pagar.<\/p>\n<p>Moltes vegades el propietari vol evadir el proc\u00e9s judicial, donant-li l&#8217;oportunitat a l&#8217;inquil\u00ed de pagar. Aix\u00f2 pot allargar tot, per\u00f2 en altres ocasions funciona. Al menys quan l&#8217;arrendatari t\u00e9 intencions de complir el contracte, per\u00f2 fets puntuals s&#8217;ho han impedit.<\/p>\n<p>Els llocs d&#8217;Espanya en els que es triga m\u00e9s el desnonament dels inquilins s\u00f3n Sevilla, M\u00farcia i M\u00e0laga. D&#8217;acord a<span style=\"color: #333333;\"> l&#8217;informe<\/span> <span style=\"color: #33cccc;\">La demora en els desnonaments. Espanya 2017<\/span> en aquestes ciutats l&#8217;expulsi\u00f3 pot demorar 367, 365 i 359 dies, en aquest ordre.<\/p>\n<p>Mentre que les ciutats en les que es tarda menys s\u00f3n \u00c0laba (317), Saragossa (320) i Biscaia (322). La mateixa font indica que la mitjana per aconseguir el desnonament a tot Espanya \u00e9s de 347 dies. L&#8217;an\u00e0lisi t\u00e9 en compte des que l&#8217;inquil\u00ed deixa de pagar la renda fins que s&#8217;executa la mesura de desallotjament.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"com-es-el-judici-de-desnonament-a-espanya\"><\/span>Com \u00e9s el judici de desnonament a Espanya?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>De vegades no hi ha m\u00e9s remei que acudir a la via judicial per sol\u00b7licitar el <strong>desnonament per<\/strong> <strong>impagament de la renda.<\/strong> Tamb\u00e9 \u00e9s possible que el propietari no sol\u00b7liciti el desallotjament de l&#8217;inquil\u00ed sin\u00f3 el pagament del deute que hagi acumulat. L&#8217;altra alternativa \u00e9s demanar la recuperaci\u00f3 de l&#8217;habitatge o local sense que es pagui l&#8217;import pendent.<\/p>\n<p>Des del moment en qu\u00e8 s&#8217;admet la demanda, l&#8217;inquil\u00ed t\u00e9 10 dies per pagar la totalitat del deute i aix\u00ed aturar el desnonament o oposar-se a la demanda. Aquest dret d&#8217;aturar el llan\u00e7ament s&#8217;anomena enervaci\u00f3 i pot acudir a la mateixa nom\u00e9s una vegada. Si torna a inc\u00f3rrer en la falta no el pot utilitzar de nou.<\/p>\n<p>En el requeriment de l&#8217;Administraci\u00f3 de Just\u00edcia que rep el demandat s&#8217;indica l&#8217;hora i el lloc de la cita, en cas que decideixi oposar-se. I t\u00e9 tres dies despr\u00e9s de rebre el requeriment per sol\u00b7licitar assist\u00e8ncia jur\u00eddica gratu\u00efta.<\/p>\n<p>Si el demandat no at\u00e9n el requeriment ni s&#8217;oposa es procedir\u00e0 al desnonament.<\/p>\n<p>Si abans de fer la demanda, l&#8217;arrendador ha enviat el burofax a l&#8217;inquil\u00ed, aquest no podr\u00e0 impedir el desnonament a trav\u00e9s de la enervaci\u00f3.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"judici-de-desnonament-per-precari\"><\/span>Judici de desnonament per precari<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Aquest cas \u00e9s m\u00e9s complex que l&#8217;anterior perqu\u00e8 al no haver-hi un contracte dep\u00e8n de la voluntat de l&#8217;inquil\u00ed d&#8217;aconseguir un acord. Des del moment en qu\u00e8 es notifica sobre la demanda a l&#8217;inquil\u00ed, t\u00e9 10 dies per contestar-la.<\/p>\n<p>La notificaci\u00f3 ha d&#8217;incloure la data de la vista que es far\u00e0 si alguna de les parts la demana o el jutge la considera oportuna. Per oposar-se al desnonament, el demandat ha de presentar un t\u00edtol v\u00e0lid o comprovar el pagament de renda.<\/p>\n<p>Al dictar sent\u00e8ncia a favor del propietari, el demandat t\u00e9 20 dies h\u00e0bils per desallotjar. Per\u00f2, no has de prendre la just\u00edcia per la teva pr\u00f2pia m\u00e0. Sol\u00b7licita l&#8217;assist\u00e8ncia d&#8217;un advocat especialista perqu\u00e8 t&#8217;indiqui qu\u00e8 fer al respecte.<\/p>\n<p>Si decideixes prendre les teves pr\u00f2pies mesures pots acabar amb un problema m\u00e9s gran i l&#8217;inquil\u00ed podr\u00e0 prendre accions legals en contra teva.<\/p>\n<p>Entre les situacions que has d&#8217;evitar estan canviar el pany a les portes perqu\u00e8 aix\u00f2 significa delicte de coacci\u00f3. Tampoc pots amena\u00e7ar el llogater ni vendre l&#8217;habitatge. En aquest \u00faltim cas tingues present que l&#8217;arrendatari t\u00e9 dret d&#8217;adquisici\u00f3 preferent.<\/p>\n<p>Una altra mesura que no pots executar \u00e9s la de suspendre els serveis del\u00a0 immoble. Estaries incomplint amb el contracte i l&#8217;arrendatari et pot demanar.<\/p>\n<p>Per evitar tenir un inquil\u00ed que incompleixi amb la seva part del contracte el m\u00e9s convenient \u00e9s prendre previsions.
