No donen un av\u00eds de la mateixa o sense ra\u00f3 aparent li diuen a empleat que ja no requereixen dels seus serveis.<\/p>\n<p>Les dones solen ser una de les m\u00e9s afectades. \u00c9s aqu\u00ed on trobem la import\u00e0ncia de con\u00e8ixer els drets de les mares treballadores. Per aix\u00f2 \u00e9s que fem tant \u00e8mfasi en estar informat a totalitat. A continuaci\u00f3 t&#8217;explicarem sobre com procedir en aquests casos.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"qualifica-el-teu-tipus-dacomiadament\"><\/span>Qualifica el teu tipus d&#8217;acomiadament<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Abans de comen\u00e7ar cal que estiguis segur el tipus d&#8217;acomiadament que has tingut i quines s\u00f3n les causes de la mateixa. Doncs existeixen els disciplinaris, els objectius, els col\u00b7lectius i els improcedents.<\/p>\n<p>Cada un t\u00e9 particularitats pr\u00f2pies. Els acomiadaments disciplinaris s\u00f3n aquells que es fan quan un treballador incompleix amb les seves activitats laborals. Aquest pot ser sancionat d&#8217;acord amb la gravetat de la falta. En aquests casos es t\u00e9 en compte l&#8217;Estatut dels Treballadors i les pol\u00edtiques de li empresa.<\/p>\n<p>D&#8217;altra banda, els acomiadaments objectius s\u00f3n aquells en els quals l&#8217;empresa decideix prescindir dels serveis per casos espec\u00edfics. Com per exemple, falta d&#8217;adaptaci\u00f3, inassist\u00e8ncies, consideraci\u00f3 d&#8217;ineptitud o raons t\u00e8cniques, organitzatives, econ\u00f2miques o de for\u00e7a major.<\/p>\n<p>L&#8217;acomiadament col\u00b7lectiu \u00e9s quan l&#8217;empresa, per motius generalment econ\u00f2mics o canvis en la seva estructura, decideix suspendre moment\u00e0niament o extingir la relaci\u00f3 laboral amb el treballador.<\/p>\n<p>I despr\u00e9s hi ha els acomiadaments improcedents. Aquests es donen quan l&#8217;empresa no segueix els passos legals per executar un acomiadament o no se li donen raons a el treballador sobre la <strong>finalitzaci\u00f3 de l&#8217;contracte.<\/strong><\/p>\n<p>\u00c9s important que puguis identificar quin \u00e9s el teu tipus d&#8217;acomiadament laboral i en base a aix\u00f2 puguis procedir a actuar com correspongui.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-2685 alignright\" src=\"http:\/\/garanley.com\/wp-content\/uploads\/despidos-improcedentes.jpg\" alt=\"despidos improcedentes\" width=\"429\" height=\"229\" \/><\/p>\n<h3><span class=\"ez-toc-section\" id=\"motius-de-declaracio-dacomiadaments-improcedents\"><\/span>Motius de declaraci\u00f3 d&#8217;acomiadaments improcedents<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Existeixen dues formes per les quals <strong>un acomiadament pot ser declarat com a improcedent.<\/strong> Les quals s\u00f3n l&#8217;incompliment de tots els requisits formals de el mateix o per no donar o expressar les raons de l&#8217;acomiadament.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"no-complir-amb-els-requisits-formals\"><\/span>No complir amb els requisits formals<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>En aquests casos l&#8217;empresa ha de regir-se per uns requisits generals que es troben reflectits en l&#8217;Estatut dels Treballadors. On s&#8217;estableix que:<\/p>\n<ul>\n<li>L&#8217;empresa ha de comunicar a l&#8217;empleat sobre el acomiadament per mitj\u00e0 d&#8217;un escrit formal i mai ha de ser nom\u00e9s verbal. Aix\u00f2 s&#8217;ha de fer amb 15 dies d&#8217;anticipaci\u00f3 si no \u00e9s un acomiadament disciplinari, ja que aquest no requereix de preav\u00eds.<\/li>\n<li>Explicar <strong>quines s\u00f3n les motivacions de l&#8217;acomiadament<\/strong> i les especificacions de la mateixa.<\/li>\n<li>Col \u00b7 locar la data en la qual procedeix l&#8217;acomiadament. Com es va explicar abans, ha de tenir almenys uns 15 dies des de la comunicaci\u00f3 a l&#8217;execuci\u00f3 formal de la finalitzaci\u00f3 de la relaci\u00f3 entre l&#8217;empresa i el treballador.<\/li>\n<\/ul>\n<p>L&#8217;incompliment d&#8217;aquests requisits porta al fet que un empleat pugui realitzar una apel\u00b7laci\u00f3 perqu\u00e8 un jutge ho dictamini com acomiadament improcedent.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"no-oferir-explicacions-concretes\"><\/span>No oferir explicacions concretes<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Si l&#8217;av\u00eds d&#8217;acomiadament no posseeix una justificaci\u00f3 adequada. \u00c9s a dir, si una empresa vol executar un acomiadament disciplinari cal que especifiquin quines van ser les faltes de treballador.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"cercar-assessoria-dun-advocat\"><\/span>Cercar assessoria d&#8217;un advocat<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>En aquests casos sempre cal comptar amb un advocat que sigui capa\u00e7 d&#8217;oferir suport i assessoria legal. Com a empresa comptem amb una \u00e0mplia varietat de serveis que van des de ser advocats d&#8217;accidents de tr\u00e0nsit a Barcelona fins tractar temes de familiars i de treball.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"demostrar-que-lacomiadament-es-improcedent\"><\/span>Demostrar que l&#8217;acomiadament \u00e9s improcedent<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Per demostrar que el teu acomiadament \u00e9s improcedent has recaptar proves d&#8217;aix\u00f2. \u00c9s aqu\u00ed on en conjunt amb el teu advocat han de demostrar davant un jutge que l&#8217;empresa no va donar cap justificaci\u00f3, va incomplir amb els requisits generals o ambdues.<\/p>\n<p>L&#8217;empresa tindr\u00e0 oportunitat de defensar-se i despr\u00e9s ser\u00e0 donada la sent\u00e8ncia on es dictaminar\u00e0 a favor de qui va ser la sent\u00e8ncia. En aquests casos \u00e9s el jutge qui decideix qui t\u00e9 la ra\u00f3 tenint en compte les proves presentades.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"demanar-reincorporacio\"><\/span>Demanar reincorporaci\u00f3<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>La reincorporaci\u00f3 no \u00e9s m\u00e9s que quan se l&#8217;obliga a l&#8217;empresari a admetre novament a treballador en l&#8217;empresa sota les mateixes condicions que aquest posse\u00efa abans de ser acomiadat.<\/p>\n<p>A m\u00e9s, se li han de pagar tots els salaris des de la data d&#8217;acomiadament fins a la seva reincorporaci\u00f3 juntament amb la cotitzaci\u00f3 de seguretat social d&#8217;aquest per\u00edode. En aquest cas, el treballador ha de tornar la indemnitzaci\u00f3 en cas d&#8217;haver rebut un.<\/p>\n<p>\u00c9s important destacar que si un acomiadament va ser declarat com a improcedent nom\u00e9s per incompliment de requisits formals. Res no li impedeix a l&#8217;empresa realitzar l&#8217;acomiadament de nou, sempre que aquesta tingui motius i proves suficients per fer-ho.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-2683 alignleft\" src=\"http:\/\/garanley.com\/wp-content\/uploads\/indemnizacion-por-despido-improcedente.jpeg\" alt=\"indemnizacion por despido improcedente\" width=\"414\" height=\"276\" srcset=\"https:\/\/garanley.com\/wp-content\/uploads\/indemnizacion-por-despido-improcedente.jpeg 595w, https:\/\/garanley.com\/wp-content\/uploads\/indemnizacion-por-despido-improcedente-272x182.jpeg 272w\" sizes=\"auto, (max-width: 414px) 100vw, 414px\" \/><\/p>\n<h3><span class=\"ez-toc-section\" id=\"demanar-indemnitzacio-per-acomiadament-improcedent\"><\/span>Demanar indemnitzaci\u00f3 per acomiadament improcedent<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Si per altra banda l&#8217;empresa es nega a fer la reincorporaci\u00f3 de l&#8217;treballador, ha de donar una indemnitzaci\u00f3 a aquest. Aix\u00f2 significaria que amb aix\u00f2 es d\u00f3na per finalitzada la relaci\u00f3 laboral entre empleat i ocupador.<\/p>\n<p>La indemnitzaci\u00f3 dep\u00e8n de la data en qu\u00e8 treballador va comen\u00e7ar a prestar els seus serveis. Si la relaci\u00f3 laboral va comen\u00e7ar abans de el 12 de febrer 2012, l&#8217;empresa ha d&#8217;abonar 45 dies per any treballat, tenint com a m\u00e0xim 42 mensualitats fins a la data ens esmentada.<\/p>\n<p>I 33 dies per any tingut com a m\u00e0xim 24 mensualitats en els anys de servei despr\u00e9s de l&#8217;12 de febrer de l&#8217;2012. Aix\u00f2 tamb\u00e9 s&#8217;aplica per a tota relaci\u00f3 laboral que va comen\u00e7ar despr\u00e9s d&#8217;aquesta data.<\/p>\n<p>Hi ha casos especials en qu\u00e8 una si l&#8217;empleat \u00e9s delegat o representant de personal, \u00e9s ell qui decideix i no l&#8217;empresa si va a preferir la readmissi\u00f3 o una indemnitzaci\u00f3.<\/p>\n<p>Com a empleat \u00e9s necessari saber qu\u00e8 fer davant un acomiadament improcedent.
