S\u00f3n el que es denominen, en termes jur\u00eddics, els vicis ocults d&#8217;una compravenda. L\u00f2gicament, ha de tractar-se de defectes que comportin un risc per als ocupants i que, si ho hagu\u00e9s sabut, l&#8217;ara propietari no l&#8217;hagu\u00e9s adquirit o, almenys, no al preu fixat.<\/p>\n<p>En el cas dels habitatges, els vicis ocults solen ser defectes de construcci\u00f3 \u2013per exemple, si s&#8217;han utilitzat materials de baixa qualitat-. Defectes que no solament afecten als habitatges nous, tamb\u00e9 les de segona m\u00e0 poden amagar-los i sortir a relluir temps despr\u00e9s de realitzar-se la compravenda. Entre els vicis ocults m\u00e9s comuns s&#8217;inclouen els problemes de canonades, esquerdes grans en les parets, despreniment de maons, humitats i filtracions i col\u00b7locaci\u00f3 de col\u00b7lectors defectuosos.<\/p>\n<p>Quan es tracta d&#8217;un habitatge nou ser\u00e0 el promotor o constructor l&#8217;encarregat d&#8217;esmenar les defici\u00e8ncies, tal com estableix la <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-1999-21567\" target=\"_blank\" rel=\"noopener noreferrer\">Llei d&#8217;Ordenaci\u00f3 de l&#8217;Edificaci\u00f3, Llei 38\/1999.<\/a> El venedor ser\u00e0 el responsable dels danys materials que afecten als elements estructurals i el termini de reclamaci\u00f3 \u00e9s de deu anys. Es redueix a tres quan els vicis ocults afecten als elements constructius o instal\u00b7lacions. I a un any per defectes d&#8217;acabat (pintura, goteres\u2026).<\/p>\n<h3><span class=\"ez-toc-section\" id=\"reclamacio-per-vicis-ocults-en-vehicle\"><\/span>Reclamaci\u00f3 per vicis ocults en vehicle<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>La compravenda de vehicles tamb\u00e9 \u00e9s objecte de vicis ocults, entenent-se com un greu defecte que afecta al seu funcionament i seguretat, com per exemple una avaria important del motor. Un defecte, imperceptible a primera vista, que no solament afecta al seu \u00fas, sin\u00f3 tamb\u00e9 al seu valor, per la qual cosa el comprador o no ho hagu\u00e9s adquirit o ho hagu\u00e9s fet a un preu molt menor. En aquest cas, des del lliurament de les claus del cotxe, tenim un termini de 6 mesos per reclamar i exigir que el venedor esmeni els defectes.
