En no pocs casos el proindiviso \u00e9s font de conflictes, especialment quan els condue\u00f1os accedeixen a la comunitat no per voluntat pr\u00f2pia, sin\u00f3 com a conseq\u00fc\u00e8ncia, per exemple, d&#8217;una her\u00e8ncia.<\/p>\n<p>El condomini es regula, en primer terme, per la voluntat i acords entre les parts. En segon lloc s&#8217;apliquen les normes espec\u00edfiques i, nom\u00e9s a falta d&#8217;ambdues, ha de rec\u00f3rrer-se a l&#8217;establert en el Codi Civil. En qualsevol cas, aquest \u00faltim text legal estableix, en el seu article 400, que cap dels comuneros es troba obligat a continuar en la comunitat. Aix\u00ed les coses, qualsevol d&#8217;ells i al moment que estimin oport\u00fa poden sol\u00b7licitar la divisi\u00f3 de la cosa comuna (acci\u00f3 de divisi\u00f3), tret que aquesta provoqui la inutilitat del ben per a l&#8217;\u00fas al que est\u00e0 destinat.<\/p>\n<p>No oblidis tampoc que els part\u00edcips poden pactar la conservaci\u00f3 indiv\u00eds del ben com\u00fa per un temps determinat, que no pot excedir de deu anys.<\/p>\n<h3>Procediments per realitzar la divisi\u00f3<\/h3>\n<p>La divisi\u00f3 de la cosa comuna \u00e9s la causa d&#8217;extinci\u00f3, per antonom\u00e0sia, de qualsevol comunitat. La conseq\u00fc\u00e8ncia fonamental de la mateixa \u00e9s que els comuneros passen a convertir-se en propietaris exclusius de la porci\u00f3 que els correspon del ben en q\u00fcesti\u00f3.<\/p>\n<p>Quan el ben \u00e9s divisible es procedeix a adjudicar una part del mateix a cada copropietari. Ara b\u00e9, imagina que la cosa no \u00e9s susceptible de fraccionar-se (indivisible). \u00c9s llavors quan entra en joc la partici\u00f3 econ\u00f2mica: el ben s&#8217;adjudica a un dels comuneros i aquest paga a la resta el preu corresponent a la quota que tenia cada condue\u00f1o en la comunitat. Una altra soluci\u00f3 \u00e9s la regulada en l&#8217;article 404 del C. c. espanyol: vendre la cosa i repartir la quantitat obtinguda entre tots, tamb\u00e9 en funci\u00f3 de l&#8217;aportaci\u00f3 de cadascun.<\/p>\n<p>La divisi\u00f3 pot efectuar-se per tres vies diferents:<\/p>\n<ul>\n<li>Contracte divisori. En aquest cas juga la voluntat i l&#8217;autonomia de les parts, que per unanimitat acorden els termes de la divisi\u00f3 de la cosa comuna.<\/li>\n<li>Amb intervenci\u00f3 d&#8217;\u00e0rbitres o amigables componedors. Nomenats pels copropietaris, han de formar parts proporcionals al dret de cadascun d&#8217;aquests, evitant en la mesura del possible els suplements a met\u00e0l\u00b7lic.<\/li>\n<li>Actio communi dividundo. La via judicial \u00e9s la tercera opci\u00f3 i es desplega quan no ha estat possible arribar a cap acord o quan un dels part\u00edcips est\u00e0 desaparegut, per exemple. D\u00f3na lloc a un proc\u00e9s declaratiu i pot concloure amb la venda de la cosa en p\u00fablica subhasta.<\/li>\n<\/ul>\n<p>Una altra q\u00fcesti\u00f3 que has de saber \u00e9s que la divisi\u00f3 de la cosa comuna no pot afectar els drets de terceres persones. Qualsevol que posse\u00eds un dret real (hipoteca, servitud&#8230;) sobre el ben abans de la partici\u00f3, ho conservar\u00e0 despr\u00e9s d&#8217;aquesta \u00faltima. El mateix ocorre amb els drets personals.<\/p>\n<p><strong>La divisi\u00f3 en el dret catal\u00e0<\/strong><\/p>\n<p>El Codi Civil de Catalunya regula en termes an\u00e0legs al C. c. espanyol la divisi\u00f3 de la cosa comuna. L&#8217;article 552-10 assenyala que els copropietaris poden exigir, a qualsevol moment, la divisi\u00f3 del ben. A m\u00e9s, tamb\u00e9 es recull la possibilitat de pactar la conservaci\u00f3 indivisa de la cosa durant un per\u00edode de fins a deu anys.<\/p>\n<p>Els procediments de divisi\u00f3 s\u00f3n tres: acord de les parts, intervenci\u00f3 d&#8217;\u00e0rbitres i, en \u00faltima inst\u00e0ncia, la via judicial. Si el ben \u00e9s un immoble susceptible de constituir-se en r\u00e8gim de propietat horitzontal, pot optar-se per aquesta via.<\/p>\n<p>Una altra de les opcions que es contempla \u00e9s l&#8217;adjudicaci\u00f3 del dret d&#8217;usdefruit sobre la cosa a un o diversos part\u00edcips i de la nuda propietat a la resta de copropietaris. D&#8217;altra banda, els cotitulars amb almenys quatre cinquenes parts de les quotes de la comunitat poden exigir l&#8217;adjudicaci\u00f3 del b\u00e9, pagant el valor pericial de la participaci\u00f3 de la resta.<\/p>\n<p>Quan el ben \u00e9s indivisible, l&#8217;adjudicaci\u00f3 s&#8217;atorga al condue\u00f1o que posseeixi inter\u00e8s en el mateix. Si existeix m\u00e9s d&#8217;un, al que tingui la participaci\u00f3 major. En cas d&#8217;interessos i participacions iguals, decideix la sort.<\/p>\n<p>Si formes part d&#8217;una comunitat i est\u00e0s pensant sol\u00b7licitar la divisi\u00f3 de la cosa comuna, o ho ha fet qualsevol dels altres copropietaris, no dubtis a contactar amb un despatx d&#8217;advocats solvent i amb experi\u00e8ncia en la mat\u00e8ria.
