Es tracta de l&#8217;extinci\u00f3 unilateral de la relaci\u00f3 laboral, motivada per incompliment greu i culpable del treballador.<\/strong><\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<p><strong>Com b\u00e9 saps, l&#8217;acomiadament \u00e9s una manifestaci\u00f3 de la facultat disciplin\u00e0ria de l&#8217;empresari, per defensar l&#8217;organitzaci\u00f3 de les possibles mancades o incompliments contractuals del treballador. Sens dubte, \u00e9s una de les mesures m\u00e9s fermes que pot adoptar qualsevol empresa, encara que afortunadament nom\u00e9s ha d&#8217;emprar-se en situacions extremes i en casos excepcionals.<\/strong><\/p>\n<p>Has de tenir en compte que l&#8217;acomiadament disciplinari exigeix dos requisits fonamentals: el treballador ha d&#8217;haver com\u00e8s un incompliment greu i, a m\u00e9s, culpable. La gravetat de l&#8217;acci\u00f3 est\u00e0 relacionada amb el perjudici a l&#8217;empresa i per valorar-la han de tenir-se en compte aspectes com el dany econ\u00f2mic causat, la qualificaci\u00f3 de l&#8217;empleat, la seva antiguitat etc. Per la seva banda, la falta \u00e9s culpable si \u00e9s fruit d&#8217;un acte conscient o negligent per part de l&#8217;empleat. Quan es donen aquestes dues premisses, l&#8217;empresari pot comen\u00e7ar a valorar la possibilitat d&#8217;aplicar un acomiadament disciplinari.<\/p>\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_17 counter-hierarchy counter-numeric ez-toc-transparent\">\n<div class=\"ez-toc-title-container\">\n<p class=\"ez-toc-title\">Resumen del art&iacute;culo<\/p>\n<span class=\"ez-toc-title-toggle\"><a class=\"ez-toc-pull-right ez-toc-btn ez-toc-btn-xs ez-toc-btn-default ez-toc-toggle\" style=\"display: none;\"><i class=\"ez-toc-glyphicon ez-toc-icon-toggle\"><\/i><\/a><\/span><\/div>\n<nav><ul class=\"ez-toc-list ez-toc-list-level-1\"><li class=\"ez-toc-page-1 ez-toc-heading-level-2\"><a class=\"ez-toc-link ez-toc-heading-1\" href=\"https:\/\/garanley.com\/ca\/dret-laboral\/acomiadament-disciplinari\/#regulacio-de-lacomiadament-disciplinari\" title=\"Regulaci\u00f3 de l&#8217;acomiadament disciplinari\">Regulaci\u00f3 de l&#8217;acomiadament disciplinari<\/a><ul class=\"ez-toc-list-level-3\"><li class=\"ez-toc-heading-level-3\"><a class=\"ez-toc-link ez-toc-heading-2\" href=\"https:\/\/garanley.com\/ca\/dret-laboral\/acomiadament-disciplinari\/#qualificacio-de-lacomiadament-disciplinari\" title=\"Qualificaci\u00f3 de l&#8217;acomiadament disciplinari\">Qualificaci\u00f3 de l&#8217;acomiadament disciplinari<\/a><\/li><li class=\"ez-toc-page-1 ez-toc-heading-level-3\"><a class=\"ez-toc-link ez-toc-heading-3\" href=\"https:\/\/garanley.com\/ca\/dret-laboral\/acomiadament-disciplinari\/#motius-que-justifiquen-un-acomiadament-disciplinari\" title=\"Motius que justifiquen un acomiadament disciplinari\">Motius que justifiquen un acomiadament disciplinari<\/a><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n<h2><span class=\"ez-toc-section\" id=\"regulacio-de-lacomiadament-disciplinari\"><\/span>Regulaci\u00f3 de l&#8217;acomiadament disciplinari<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&#8217;acomiadament disciplinari ve regulat en els articles 54 i seg\u00fcents de l&#8217;Estatut dels Treballadors, que estableixen: \u201cEl contracte de treball podr\u00e0 extingir-se per decisi\u00f3 de l&#8217;empresari, mitjan\u00e7ant acomiadament basat en un incompliment greu i culpable del treballador\u201d.<\/p>\n<p>Els requisits formals que han de complir-se en l&#8217;acomiadament disciplinari s\u00f3n els que apareixen en el precepte 55 de l&#8217;Estatut:<\/p>\n<ul>\n<li>Notificaci\u00f3 per escrit. Si ets objecte d&#8217;un acomiadament disciplinari, el teu empresari ha de comunicar-t&#8217;ho per escrit. En la carta d&#8217;acomiadament han de figurar els fets que ho motiven i la data a partir de la qual produir\u00e0 efectes.<\/li>\n<li>Treballador delegat sindical o delegat de personal. En aquest cas, \u00e9s necessari obrir un expedient contradictori, en el qual se sentir\u00e0 al treballador i als seus representants.<\/li>\n<li>Treballador afiliat a un sindicat. Si aquest extrem li const\u00e9s a l&#8217;empresari, haur\u00e0 de donar-se audi\u00e8ncia pr\u00e8via als delegats sindicals.<\/li>\n<li>Convenis col\u00b7lectius. Els convenis col\u00b7lectius poden recollir altres exig\u00e8ncies formals per a l&#8217;acomiadament, amb independ\u00e8ncia de les establertes en l&#8217;Estatut dels Treballadors.<\/li>\n<\/ul>\n<p>L&#8217;incompliment de les exig\u00e8ncies formals que acabem d&#8217;enumerar pot portar a l&#8217;empresa a realitzar un nou acomiadament, que contingui les premisses omeses en l&#8217;anterior. El nou ha d&#8217;efectuar-se en un termini de 20 dies des de l&#8217;endem\u00e0 al del primer i assorteix efectes des de la seva data.<\/p>\n<p>L&#8217;empresari ha de liquidar les retribucions pendents de pagament fins avui de l&#8217;acomiadament i lliurar la quitan\u00e7a a l&#8217;empleat.<\/p>\n<p>L&#8217;acomiadament disciplinari ha d&#8217;efectuar-se dins dels 60 dies seg\u00fcents a la data en la qual l&#8217;empresa va tenir coneixement de l&#8217;incompliment laboral de l&#8217;empleat i, en tot cas, als 6 mesos d&#8217;haver-se com\u00e8s aquest (article 60 de l&#8217;Estatut dels Treballadors).<\/p>\n<h3><span class=\"ez-toc-section\" id=\"qualificacio-de-lacomiadament-disciplinari\"><\/span>Qualificaci\u00f3 de l&#8217;acomiadament disciplinari<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>L&#8217;acomiadament disciplinari pot qualificar-se com a procedent, improcedent o nul. Es considerar\u00e0 procedent quan s&#8217;acrediti l&#8217;incompliment que al\u00b7lega l&#8217;empresari. Ser\u00e0 improcedent quan no es produeixi tal acreditaci\u00f3 o quan no es compleixin els requisits formals ressenyats a l&#8217;apartat anterior. Finalment, s&#8217;estimar\u00e0 nul aquell acomiadament que es base en qualsevol de les causes de discriminaci\u00f3 prohibides en la Constituci\u00f3 o en la llei, o b\u00e9, tingui com resultat la violaci\u00f3 d&#8217;un dret fonamental o d&#8217;una llibertat p\u00fablica del treballador.<\/p>\n<p>L&#8217;article 55.5 de l&#8217;Estatut dels Treballadors recull altres casos, en els quals l&#8217;acomiadament tamb\u00e9 ha d&#8217;estimar-se nul:<\/p>\n<ul>\n<li>El de treballadors en per\u00edode de suspensi\u00f3 de contracte de treball per maternitat, risc durant l&#8217;embar\u00e0s, durant la lact\u00e0ncia natural, malalties de l&#8217;embar\u00e0s, part o lact\u00e0ncia natural, adopci\u00f3, acolliment o paternitat, a m\u00e9s del notificat en una data en la qual el preav\u00eds concedit finalitzi dins d&#8217;aquest per\u00edode.<\/li>\n<li>El de treballadors despr\u00e9s de reintegrar-se al treball, despr\u00e9s de finalitzar els per\u00edodes de suspensi\u00f3 del contracte per maternitat, adopci\u00f3, acolliment o paternitat, sempre que no haguessin passat m\u00e9s de 9 mesos des del naixement, adopci\u00f3 o acolliment.<\/li>\n<\/ul>\n<p>Com pots imaginar, si l&#8217;acomiadament disciplinari no est\u00e0 motivat per causes relacionades amb l&#8217;embar\u00e0s o amb els permisos assenyalats, no cal aplicar els punts anteriors.<\/p>\n<p>Els acomiadaments qualificats nuls suposen la readmissi\u00f3 immediata del treballador, amb abonament de salaris no rebuts.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"motius-que-justifiquen-un-acomiadament-disciplinari\"><\/span>Motius que justifiquen un acomiadament disciplinari<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Com t&#8217;hem indicat anteriorment, un empresari pot extingir un contracte laboral de manera unilateral si esdev\u00e9 un incompliment greu i culpable del treballador. Doncs b\u00e9, la llei espanyola considera incompliments contractuals les seg\u00fcents actuacions:<\/p>\n<ul>\n<li><strong>Faltes injustificades d&#8217;assist\u00e8ncia o puntualitat.<\/strong><br \/>\nEn aquest punt existeixen dues notes fonamentals: la repetici\u00f3 i la falta de justificaci\u00f3. L&#8217;Estatut no estableix un nombre concret de faltes o retards a tenir en compte per\u00f2, en qualsevol cas, tots dos han de ser reiterats. Els convenis col\u00b7lectius regulen aquests l\u00edmits m\u00e9s detalladament. La jurisprud\u00e8ncia ve considerant que, a partir de tres faltes d&#8217;assist\u00e8ncia mensuals injustificades, pot parlar-se d&#8217;incompliment greu.<\/li>\n<li><strong>Indisciplina o desobedi\u00e8ncia.<\/strong><br \/>\nNo obstant aix\u00f2, conv\u00e9 no oblidar que el treballador pot oposar-se a les ordres de l&#8217;empresari, quan aquestes siguin not\u00f2riament il\u00b7legals. A m\u00e9s, sembla l\u00f2gic que no totes les desobedi\u00e8ncies hagin de castigar-se amb un acomiadament disciplinari. \u00c9s per aix\u00f2 que ser\u00e0 necessari determinar el grau de gravetat i culpabilitat en cada cas.<\/li>\n<li><strong>Ofenses verbals o f\u00edsiques.<\/strong><br \/>\nEs tractaria d&#8217;ofenses verbals o f\u00edsics a l&#8217;adre\u00e7a de l&#8217;empresa, els companys, clients, familiars d&#8217;aquests, prove\u00efdors etc. Igual que a l&#8217;apartat anterior, caldr\u00e0 estudiar cada cas per concloure si \u00e9s o no motiu d&#8217;acomiadament.<\/li>\n<li><strong>Mala fe o ab\u00fas de confian\u00e7a.<\/strong><br \/>\nEn aquest apartat podrien incloure&#8217;s els enganys, la neglig\u00e8ncia, l&#8217;ab\u00fas de confian\u00e7a, la deslleialtat etc.<\/li>\n<li><strong>Falta de rendiment.<\/strong><br \/>\nLa falta de rendiment en el treball ha de ser continuada i volunt\u00e0ria, a m\u00e9s de produir-se per raons no conjunturals. La voluntarietat o la falta de dilig\u00e8ncia tamb\u00e9 s\u00f3n ingredients en aquest motiu per a l&#8217;acomiadament disciplinari.<\/li>\n<li><strong>Embriaguesa o toxicomania.<br \/>\n<\/strong>Sempre que, aquestes situacions influeixin negativament en el lloc de treball i en la labor que duu a terme l&#8217;empleat.<\/li>\n<li><strong>Discriminaci\u00f3 i assetjament.<\/strong><br \/>\nTot tipus de conductes que atemptin contra la dignitat de les persones, com la discriminaci\u00f3, l&#8217;assetjament sexual o el mobbing.<\/li>\n<\/ul>\n<p>Si has sofert un acomiadament disciplinari que cre\u00efs improcedent o nul, dirigeix-te a un bufet d<a href=\"http:\/\/garanley.com\/ca\/especialitats\/laboral\/\">&#8216;advocats laboralistes<\/a>.
